The victim of a chargeback

Last November I sold a Samsung Galaxy S mobile phone on ebay for £300.  The woman I sold it too came to collect the phone, paid through PayPal and everything was fine.

But in January she filed a chargeback and won the case because there was no proof of her receiving the phone, because she came and picked it up.  Therefore, there was no tracking number or any other proof of her taking possession of the phone and PayPal refuses to take any responsibility.

I then contacted the police, because PayPal told me that this was what I needed to do.  The police told me that I needed to speak to PayPal- which I have already done dozens of times.   but they told me to look at this site, and to review PayPal’s policies.

After reviewing PayPal’s policies, I found that I could dispute this chargeback if I have e-mails from the buyer (which I do) stating that she’d come to collect the phone.  I also have messages on ebay from her saying the same.

So what should I do now? if any of you could help or give me advice please do.

    Hello Thomas.

    If you have not already forwarded the email’s from the customer to the resolution center, this would be the first thing to do. Since you were the seller, however, and PayPal has already refunded the buyer, they are not likely to reverse their decision.

    Also, if the buyer actually did the chargeback through their credit card company PayPal will not want to help you, no matter what you send them.

    I live in the USA and am not familiar with UK law, but the police here would likely not be much help for such a small case. If you have the buyers personal information you could take them to small claims court (I believe in the UK it is called “County Court”).
