Paypal is not releasing my Reserve

I signed up for Paypal Merchant Services August 27, 2011, since I was a new Merchant they told me they would take 30% of my credit card charge amounts and put them in a rolling reserve and after 90 days they would begin releasing amounts back into my account and after 90 days they would review the account and lower or eliminate the 30% and release the reserve.
I figured I could deal with this for 90 days and proceeded about running my business. At 90 days I contacted them about the release and after 3 days got the reply that they had reviewed my account and would not be reducing or releasing anything, I make a weekly appeal to Paypal Merchant services who now are hold 38,000.00, yes that is 38,000.00 on reserve,they have no answer as to why, they now have given me several dates that they will review the account again, but I have lost all faith, I have filed with the BBB and have contacted and attorney, Has anyone ever gotten their reserve released?
